Terms of Service

Thank you for choosing Rush Acquisition LLC, doing business as Rush Digital Marketing, to support your lead generation efforts. These Terms of Service govern the services we provide and outline how our engagement works.
By submitting payment, electronically accepting these Terms, or otherwise engaging our services, you agree to be bound by them.
1. Services
Rush Digital Marketing provides organic LinkedIn lead generation and appointment-setting services.
The setup process typically takes 1 to 2 weeks, although timelines may vary depending on the individual situation.
During setup, services may include:

Client onboarding and setup

LinkedIn profile optimization

Custom message sequence creation
-
Automation and tracking systems setup
-
Nexus DFY access
Once setup is complete, the campaign will go live.
Ongoing monthly services may include:

Connecting with your target audience on LinkedIn

Sending outreach messages
-
A/B testing
-
Managing pending invites
-
Tracking KPIs
-
Optimizing campaigns
-
Providing progress reports
-
Appointment setting
-
Lead nurturing
2. Client Requirements
To support campaign performance, the Client agrees to:

Complete the onboarding questionnaire

Watch the “Setting The Foundations” intro video provided
-
Provide a Calendly booking link with a Standard Plan
-
Upgrade to LinkedIn Sales Navigator
-
Respond to Slack messages in a timely manner
3. Payment Terms
The first month’s payment is required before services begin.
Services are billed monthly, and the payment method on file will be charged automatically every 30 days unless the engagement is terminated in accordance with these Terms.
Clients will be notified by email 7 days before the next payment is deducted.
We accept ACH, credit card, and debit card payments.
4. Initial Cancellation Window
The Client may cancel the agreement until midnight of the third business day after the initial payment is submitted.
To do so, the Client must send written notice by email or Slack before that deadline.
Notice sent after that deadline may be deemed invalid at the Company’s discretion.
5. Month-to-Month Term
After the initial payment, the engagement continues on a month-to-month basis unless terminated by either party in accordance with these Terms.
6. Rules of Engagement
The Client understands and agrees to the following:
Rush Digital Marketing operates with the Client’s best interests in mind when making campaign decisions and optimizations.
The services provided are intended to support the Client’s broader sales and business development efforts. Lead generation is one part of a larger growth process and does not guarantee specific business outcomes.
The Client agrees to allow Rush Digital Marketing to execute its process without interference so the campaign can be run effectively.
The Client remains responsible for the overall growth of their business, including sales conversion, client fulfillment, and all business development efforts beyond the scope of this engagement.
Rush Digital Marketing serves multiple clients at the same time. The Client agrees to respect the time and availability of the team and trust that deliverables will be provided as outlined.
Failure to comply with these expectations may reduce the Company’s ability to deliver consistent long-term results.
7. Termination
Either party may terminate services at any time.
If the Client wishes to terminate services, the Client must submit a written request by email or Slack at least 3 days before the desired termination date.
Payments already made are non-refundable.
If the Client chooses to resume services in the future, updated services or pricing may apply.
8. No Refund Policy
All payments made for services are final and non-refundable.
This includes situations involving:

dissatisfaction with performance
-
dissatisfaction with timing or results
-
early termination by the Client
-
changes in business circumstances
-
subjective disagreement with campaign direction or outreach style
9. No Guarantees
Rush Digital Marketing does not guarantee any specific result, including but not limited to:

number of leads
-
number of replies
-
number of booked calls
-
revenue generated
-
sales closed
-
lead quality or fit
Any examples, estimates, benchmarks, or past results shared in sales conversations, emails, or marketing materials are illustrative only and should not be interpreted as guarantees.
Campaign performance depends on many factors, including niche, offer strength, audience response, market conditions, and Client responsiveness.
10. Additional Services
Services outside the scope of the engagement are not typically included.
If the Client requests additional work and the Company agrees to provide it, that work will be billed at $500 per hour.
Additional services must be approved in writing before they are performed. Approval by Slack or email is sufficient.
11. Limitation of Liability
Rush Digital Marketing is not liable for any incidental, consequential, indirect, or special damages, or for any loss of profits, business interruption, or related losses arising from the performance or nonperformance of the services.
The Client understands that outcomes may vary based on the information provided, external market conditions, and third-party tools or platforms used in the strategy.
The Company is not liable for delays, restrictions, platform changes, software issues, policy changes, or any other circumstances outside its control.
If a third-party platform or tool prevents the Company from delivering services, the Company may pause campaign activity while supporting the Client in resolving the issue.
12. Communication
Client communication is handled via Slack.
Office hours vary due to time zone differences, but are generally Monday through Friday.
Rush Digital Marketing typically responds within 24 to 48 hours, excluding weekends and standard public holidays.
13. Entire Agreement
These Terms of Service represent the complete understanding between the parties regarding the services provided.
No modification or amendment is effective unless it is made in writing and signed by both parties.
